General Terms and Conditions

1. Scope

The following General Terms and Conditions (GTC) apply to all orders placed through our online shop. Our online shop is exclusively aimed at consumers. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity. An entrepreneur is a natural or legal person or a legal partnership that acts in the exercise of its commercial or independent professional activity when concluding a legal transaction.

2. Contracting Party, Conclusion of Contract

The purchase contract is concluded with Luxury Marine Toys GmbH.

By placing products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products non-bindingly in the shopping cart and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. The contract is concluded by you accepting the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation via email.

3. Contract Language, Storage of Contract Text

The languages available for concluding the contract are German and English.

We do not store the contract text.

4. Delivery Conditions

In addition to the stated product prices, shipping costs will be added. You can find more details about the amount of shipping costs with the offers.

You generally have the option of picking up your order at Luxury Marine Toys GmbH, Stadtring 13, 33647 Bielefeld, Germany, during the business hours stated below: Monday to Friday from 10:00 AM to 6:00 PM, Saturday from 10:00 AM to 2:00 PM, except on public holidays. Please inform us at least two working days before your collection so that we can prepare the goods from our warehouse.

We do not deliver to parcel stations.

5. Payment

The following payment methods are generally available in our shop:

    • Prepayment If you choose the payment method prepayment, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment.

    • Credit Card By submitting your order, you simultaneously transmit your credit card data to us. After you have legitimate yourself as the rightful cardholder, we will immediately after the order request your credit card company to initiate the payment transaction. The payment transaction is carried out automatically by the credit card company and your card is charged.

  • PayPal During the order process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, legitimize yourself with your access data, and confirm the payment instruction to us. After submitting the order in the shop, we will request PayPal to initiate the payment transaction. The payment transaction is then carried out automatically by PayPal immediately. You will receive further instructions during the order process.

6. Retention of Title

The goods remain our property until full payment has been received.

7. Warranty and Guarantees

The statutory liability for defects applies. Information on any additional guarantees and their exact conditions can be found with the product and on special information pages in the online shop.

8. Liability

For claims based on damages caused by us, our legal representatives, or vicarious agents, we are always liable without limitation:

    • in the event of injury to life, body, or health,
    • in the event of intentional or grossly negligent breach of duty,
  • in the event of guaranteed promises, if agreed, or
  • insofar as the scope of the Product Liability Act is applicable.

In the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations), due to slight negligence by us, our legal representatives, or vicarious agents, liability is limited in amount to the foreseeable damage typical for the contract at the time of its conclusion. Otherwise, claims for damages are excluded.

9. Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find here: https://ec.europa.eu/consumers/odr/. We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
